there is no binding rule about which transactions are selected by a miner to be included in the block it mines.

although the rule of thumb should be selected from highest-paying transaction, that is not always the case, that is only to maximise the miner's profit.

remember a case in bitcoin where a specific miner mined empty blocks, just because they can.
